By ordering Design or Web Hosting services you are agreeing to these Hosting and Design Terms.
All design work is billed at the site. Major design projects like new sites, redesigns, images, adding new pages or new functionality must be given a quote. A quote will be given after we have clearly out lined and agreed on the requirements for the project. Changes can be made once a major project is completed, but you will be billed $20 per hour for any time over 1 hour. All major design projects will require a downpayment before any work will be started. The down payment will be 30% of the estimated labor plus the cost of any server side programs. The remaining balance will be due before the project goes live unless a prior arrangement has been made.
Design work is not refundable unless we did not design to the requirements that we had agreed upon. Once we have started a major project you can request that we stop work at any time. You will only be billed for time spent up to that point. If we have not started the work you will only be billed the amount of your downpayment.
Hosting fees are dependent on which hosting plan you choose. Customers paying for their hosting plan monthly are responsible for making their payments on time on their own. No monthy billing statement or invoice will be sent out. Hosting plans go from 12:00 midnight on the 1st day of the month to 12:00 midnight on the last day of the month. Your payment will always be due on the 1st day of the month. If your payment has not been received by the 10th day of the month your site will be turned off until you make your payment. Customers paying for their hosting plan yearly will be sent an invoice approximately 30 days prior to your payment's due date. If your payment is not received by 30 days after your payment's due date your site will be turned off until you make your payment. Paying for your hosting yearly means you agree that no refund, partial or full, will be made at anytime during or after the contract period unless Trinity Web Concepts becomes unable to provide service. Any hosting plan that is 60 days over due will be considered dead, your site will be removed from our servers and you will need to start over and pay another set up fee if you decide to continue hosting with Trinity Web Concepts.
Hosting fees are only refundable under 2 conditions. If we have verified that your site was down on 2 computers (usually yours and ours) at the same time for more than 1 hour. The refund rate is the Hosting Rate divided by the number of days in the month, then multiplied by the number of days we were able to verify that the site was down. It is also refundable if for some reason Trinity Web Concepts is no longer able to provide service.
All Hosting and Design customers must agree to follow our Acceptable Use Policy.
Trinity Web Concepts is a Christian organization and will not tolerate any pornographic, hate or questionable material. Trinity Web Concepts reserves the right to censor all material and to determine if it is appropriate to be on our server. If any pornographic, hate or questionable material is found your site will be taken down immediately. You will then be given 24 hours to remove all such material. If the pornographic, hate or questionable material is not removed with in 24 hours Trinity Web Concepts will remove it by erasing your whole site. If Trinity Web Concepts needs to remove the material from your site or if it shows up there a 2nd time your site will be taken down permanently. Since Trinity Web Concepts leases our servers from an other company, we also have to answer to their acceptable use policy. If the company Trinity Web Concepts leases its servers from reports any pornographic, hate or questionable material Trinity Web Concepts taken down your site permanently without warning. Trinity Web Concepts will not be responsible for any lost revenue or data and you will not be refunded. There will not be any exceptions made. If you have a guestbook or any other feature that will allow the end user to write to your pages or store data on the server, I would recommend monitoring it very closely. If you have content that you are not sure about we suggest that you ask us our opinion before posting it to your web site.
Trinity Web Concepts is not financially responsible for any financial loses you may have suffered because of design errors or server down time.
